1) Who we are
The Colorful Couch Mental Health Counseling PLLC (“The Colorful Couch,” “we,” “us,” or “our”) provides psychotherapy services in New York and Connecticut through licensed clinicians. We also publish general information on this Site.
2) Acceptance of these Terms
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. We may update these Terms from time to time, and your continued use constitutes acceptance of the updated Terms.
3) Not medical advice; emergencies
- The Site is for general information only and does not provide medical or mental health advice, diagnosis, or treatment.
- Do not use the Site for emergencies or urgent situations. If you are in crisis, call or text 988, dial 911, or go to the nearest emergency room.
4) Eligibility & location
Clinical services are available only to clients located in states where our clinicians are licensed (currently New York and Connecticut). By requesting services, you confirm you will be physically located in a covered state at the time of the session.
5) Privacy
Your privacy matters to us. Please review our Privacy Policy & HIPAA Notice to understand how we collect, use, and protect information.
6) Permitted use of the Site
You may use the Site for lawful, personal, and non-commercial purposes. You agree not to:
- Attempt to gain unauthorized access to any systems or data, or interfere with Site operation;
- Scrape, crawl, index, or harvest data from the Site except via publicly documented standards such as search engine indexing;
- Submit content that is unlawful, infringing, or that contains malware or spam;
- Impersonate any person or misrepresent your affiliation with any person or entity.
7) Accounts & forms
- Admin access: Any admin dashboard or login areas are for authorized users only.
- Forms: Do not include Protected Health Information (PHI) in general web forms. Use our client portal for secure messages and document sharing.
8) Intellectual property
The Site, including text, graphics, logos, and other content, is owned by The Colorful Couch or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written permission, except for personal, non-commercial use where permitted by law.
9) Third-party services & links
The Site may link to third-party websites or services (e.g., client portal, payment processors). We are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their terms.
10) Payments
If you pay for services, payments may be processed by third-party providers. Fees and billing practices are described on our Fees & Insurance page and as provided during scheduling.
11) Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted or error-free.
12) Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US$100).
13) Indemnification
You agree to defend, indemnify, and hold harmless The Colorful Couch and our clinicians, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or your violation of these Terms.
14) Changes to the Site
We may modify, suspend, or discontinue any part of the Site at any time without notice.
15) Termination
We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms.
16) Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction of state and federal courts located in New York County, New York for any dispute arising from these Terms or your use of the Site.
